New third edition of the TCC guide

The Technology and Construction Court (TCC) has issued a third edition of its guide. 

There are a number of key points to note:

  • The TCC at the Rolls Building in London will not not usually deal with enforcement of adjudicator's decisions where the amount in issue is less than £100,000.  For claims generally they will usually not accept cases which are valued at less than £500,000.  These limits do not apply outside of London.  It is worth considering issuing proceedings in the regions. Mills & Reeve has offices in Birmingham, Leeds and Manchester, where TCC judges are based.
  • Adjudication enforcement hearings will usually take place within 6 to 8 weeks. 
  • There are changes to the case management directions form (Appendix B) and the draft directions order in adjudication enforcement proceedings (Appendix F).
  • The following new appendices are included: Appendix I - general guidance on Statements of Case,  Appendix J - General Guidance on Electronic Court Bundles and Appendix K - the BPC (Business and Property Courts) Protocol for Remote and Hybrid Hearings.
