NHS Provider Selection Regime regulations and statutory guidance published

Yesterday (19 October 2023) the Department of Health and Social Care introduced into Parliament draft Provider Selection Regime (PSR) regulations and NHS England published its draft statutory guidance to support implementation of the PSR regulations.

The PSR sets out the new rules for procuring health care services and will be relevant to Integrated Care Boards, NHS trusts and NHS foundations trusts, local authorities and NHS England.

Subject to parliamentary scrutiny, the DHSC intends for the PSR to come into force on 1 January 2024. But until the new framework is in force, you should continue to follow the current rules for the procurement of health care services.

A draft toolkit has also been published alongside the draft regulations and statutory guidance to help support implementation of the PSR.
