Judicial Review of FOS decisions
One of the biggest criticisms about the Financial Ombudsman Service (FOS) is that is that it does not have to comply with the common law. As long as the decision is, “just, fair and reasonable in all the circumstances”, the Ombudsmen can reach any decision they like. We consider the implications of this in light of R (Aviva Life & Pensions (UK) Ltd) v FOS (2017).
